County Treasurer
position off GOP ballot
The name of Danna Lee, former GOP candidate for the position of Liberty County
Treasurer, will be missing from the Republican ballot for the March 9 primary
election. Lee's candidacy has been withdrawn, based upon a just-received final
determination by the Elections Division of Texas' Secretary of State. The question
of position vacancy arose when Democrat Janet Harrelson, elected to that position
in November, 2002, was first refused the opportunity to take her oath of office
hours before that ceremony was scheduled, then eventually charged with and found
guilty of forgery, tampering with documents, and abuse of office. Ben Hanson,
general counsel for the Elections Division, based the final decision on Article
16, Section 44 of the Texas Constitution. Hanson said that Article provides for
a "constitutional hold-over
provision" that, in simple terms, says that because Harrelson took an oath
for the unexpired term ending 12/31/02, she is entitled to hold office until
the
final determination in her appeals process.
